The Collaborative Law Process

In the Collaborative Law process each of you has your own Collaborative Lawyer throughout who will provide you with independent legal advice throughout the process. Your Collaborative Lawyer signs an Agreement with you at the outset which disqualifies them from representing you at Court should the process break down, which means that your Collaborative Lawyer is committed to helping you avoid contested Court proceedings by reaching an agreed solution that works for you and your family.

Within the process you and your Collaborative Lawyer sit down together with the other person and their Collaborative Lawyer and discuss the issues that are important to you face to face. You and the other person set the agenda for a series of four-way meetings at which your Collaborative Lawyers will help you discuss the issues that matter to you and negotiate an agreement.

Any documents that need to be drawn up recording any agreement reached can be considered and agreed within the process. If you are divorcing or dissolving a civil partnership then the petition for divorce or dissolution can also be drawn up and agreed as part of the process.

You are in control of the pace of the process because Court dates and appearances do not govern it. The fact that there are no Court proceedings hanging over you and that you are continuing to meet and talk means that the Collaborative Law process often leads to improved relations between the parties and a better level of understanding and agreement, which can be especially important when there are children.
